Collin County District Attorney Greg Willis has responded to allegations raised by Mike Howard, the lead defense attorney for Karmelo Anthony, who was sentenced to 35 years in prison for the murder of Austin Metcalf. Howard's affidavit, part of Anthony's appeal, argues that prosecutors violated a supposed agreement meant to limit character evidence regarding Anthony and the Metcalfs.
Willis counters that court transcripts obtained by CBS News Texas refute many of Howard's assertions. He remarked that the claims do not align with the actual court proceedings. During a private discussion about Anthony's potential testimony, Howard admitted that the agreement was honored, while Judge John Roach Jr. indicated that he would not enforce informal agreements in criminal cases.
Howard's affidavit claims he believed Anthony would testify but suggests that the judge restricted their preparation time. However, the transcript reveals that the judge thoroughly explained Anthony's rights and allowed ample time for the defense to confer, during which Anthony spoke with his parents before opting not to testify.
Willis expressed his surprise and disappointment regarding Howard's statements, defending the prosecution's actions as fair and professional. Howard did not respond to inquiries and will not take part in the forthcoming appeal. Willis believes the appeal will likely be rejected, affirming confidence in the integrity of the prosecution's conduct. The first hearing related to the appeal could take place as soon as next month.
